Cross-Border Asset Disputes Singapore 2026: Legal Advice You Need to Know

For Australian expats living in Singapore, assets are often spread across multiple countries. You may maintain bank accounts and investments overseas, own one or more properties in Australia, or hold interests in trusts or companies. While this diversification offers financial flexibility, it also creates significant complexity — particularly if a marriage or de facto relationship breaks down.

When a couple faces divorce, the division of cross-border assets raises a host of legal questions. Where should the divorce be filed? Which country's courts have jurisdiction over property settlements? Can a Singapore court order be enforced in Australia?

We spoke with Elaine Li, Special Counsel and Accredited Specialist in Family Law at Lander & Rogers, to get clear answers for Australian expats navigating these issues in 2026.

Where Should the Divorce Be Filed — Australia or Singapore?

The answer depends on your individual circumstances. In Australia, the Federal Circuit and Family Court of Australia has jurisdiction to make divorce orders and will also recognise a valid divorce order issued by an overseas court.

You can apply for a divorce in Australia if, at the time of filing:

  • You are an Australian citizen, or

  • You are domiciled in Australia, or

  • You have been ordinarily resident in Australia for at least one year immediately before filing.

The parties must also have been separated for at least 12 months, with no reasonable likelihood of resuming married life together.

For property settlement, however, the decision on whether to file in Singapore or Australia depends on a range of factors — where the assets are located, where the parties live, and which forum is most appropriate for resolving the dispute. This is a complex decision that requires careful legal advice tailored to your situation.

What Assets Are Considered Divisible in an Australian Divorce?

Under the Family Law Act 1975 (Cth), the Australian Court must identify all assets, liabilities, and financial resources of both parties — regardless of whose name they are in or where the assets are located. This includes assets acquired:

  • Before the relationship

  • During the relationship

  • Even after separation

Commonly divisible assets include:

  • Real estate (in Australia or overseas)

  • Bank accounts

  • Rental income

  • Shares and investments

  • Motor vehicles

  • Cryptocurrency

  • Interests in companies or trusts

  • Superannuation

Money owed by a third party to either individual may also be considered an asset. Gifts and inheritances received by either party may also form part of the property pool available for division.

How Can Australian Expats Protect Their Assets?

There are several steps Australian expats in Singapore can take to protect their personal and financial interests following separation:

  • Binding Financial Agreements — These agreements, which can be entered into before, during, or after a marriage or de facto relationship, record how the parties intend their property, financial resources, and liabilities to be dealt with if they separate.

  • Interim Orders and Injunctions — These can prevent property from being sold, transferred, or otherwise dealt with while the dispute is ongoing. If an asset has already been sold, orders can be made to preserve the sale proceeds.

  • Reviewing Trusts and Company Structures — Property owned by a trust may not be treated as property of the parties unless it can be established that one or both parties has control over the trust. This is an area where expert legal advice is essential.

Are Singapore Court Judgments Enforceable in Australia?

Under the Foreign Judgments Act 1991 (Cth), Singapore and Australia have reciprocal arrangements. This may allow a Singapore court judgment to be registered and enforced in Australia — but there are conditions.

For a judgment to be recognised and enforceable in Australia, it must:

  • Be a "money judgment" for a definitive sum of money

  • Have been issued by a Singapore court exercising jurisdiction recognised under Australian law

  • Be final and conclusive

  • Have been made within the last six years

  • Not have been wholly or partly satisfied

A Singapore court order for the payment of money from one spouse to another may be enforceable as a registrable money order in Australia. However, the Foreign Judgments Act 1991 (Cth) excludes matrimonial property settlements that require the transfer or division of property.

In cases where a Singapore court order cannot be registered or enforced in Australia, it may be possible to seek "mirror orders" — obtaining new orders in Australia that replicate the Singapore court's arrangement. This offers a practical enforcement alternative.

Enforcing Child Support and Spousal Maintenance Orders

Under the Child Support (Registration and Collection) Act 1988 (Cth), child maintenance and spousal maintenance orders made overseas can be registered and collected in Australia through the Child Support Registrar.

For orders made in Singapore, separate statutory regimes may assist with registration and enforcement. This can be done by applying to Services Australia (within the Commonwealth Department of Health and Human Services).

Such orders are registrable and enforceable where:

  • The child lives with a parent in Australia, or

  • The child lives with a parent in Singapore and the paying parent lives in Australia

Key Takeaways for Australian Expats

Cross-border asset disputes are legally complex and emotionally challenging. If you're an Australian expat in Singapore facing separation or divorce, here are some practical steps:

  • Seek early legal advice — The earlier you understand your rights and obligations, the better positioned you are to protect your interests.

  • Know your options — Understand where you can file for divorce and property settlement, and what factors influence which forum is most appropriate.

  • Consider a Binding Financial Agreement — If you're entering a relationship or marriage, this can provide clarity and protection for both parties.

  • Plan for enforcement — A court order is only as good as its enforceability. Understand whether your Singapore judgment can be registered or enforced in Australia, or whether mirror orders are needed.

Final Note

The information in this article is intended as a general guide only and does not constitute legal advice. Every situation is unique, and you should consult a qualified family law practitioner who understands both Australian and Singapore law before making any decisions about divorce, asset division, or enforcement of court orders.
